Terms of Service

1. Who these terms are between

These terms are an agreement between you (the salon or spa signing up, the "Customer") and Skye, salon and spa management software operated by SKYE SYSTEMS LLC, a Wyoming (USA) limited liability company (registration no. 2026-002017903), with registered address at 5830 E 2nd St, Ste 7000 #36958, Casper, Wyoming 82609, USA. By creating an account you agree to these terms and to our Privacy Policy.

2. The service

Skye is a subscription tool for managing bookings, clients, staff, payments and related salon operations. We may add, change or remove features to improve the service. We aim for high availability but do not guarantee the service will be uninterrupted or error-free.

3. Your account

You are responsible for your account, for keeping login details secure, and for what your team does under it. You must give accurate information and use the service lawfully. The account owner may invite team members and set their access levels.

4. Your clients' data

When you use Skye to manage your clients' and staff's data, you are the data controller and Skye is your processor. Our handling of that data is governed by our Data Processing Agreement, which forms part of these terms.

5. Fees and billing

The service is provided on a subscription. Fees, billing cycle and any trial are shown when you subscribe. Payment is handled by our payment provider. Unless the law requires otherwise, fees already paid are non-refundable. If payment fails, we may suspend access after notice.

6. The beta program

Skye is currently offered as a beta program, open to a limited number of salons. While your account is on the beta plan, the following applies in addition to the rest of these terms:

7. Cancellation and data

You can cancel at any time from your account settings. On cancellation your access ends at the close of the paid period. You can close your account, which schedules it for deletion after a 30-day recovery window; after that window your data is permanently deleted, except records we must keep by law (such as invoices). You are responsible for exporting anything you need before then.

8. Acceptable use

You must not misuse the service: no unlawful content, no attempts to breach security or access other tenants' data, no scraping or reselling the service, and no uploading of malware. We may suspend accounts that break these rules.

9. Intellectual property

Skye and its software are owned by us. You keep ownership of your own data. You grant us the limited rights needed to run the service for you.

10. Liability

To the extent the law allows, the service is provided "as is", and our total liability is limited to the fees you paid in the three months before the claim. We are not liable for indirect or consequential loss. Nothing here limits liability that cannot be limited by law.

11. Changes and governing law

We may update these terms; for material changes we tell you in the app or by email, and the "last updated" date changes. These terms are governed by Spanish law, and disputes are subject to the competent Spanish courts.
